The operator of the website is Irving Gallery, based at 28 Essex Street, Oxford OX4 3AW, United Kingdom.  Irving Gallery is a UK-based art gallery selling original artworks and limited edition prints, as well as contemporary crafts.

We have set out below the terms and conditions which apply to information shown in the pages of our website ("the Website") and to the ordering of any products from the Website. The content of the pages of this website is for your general information and use only. It is subject to change without notice.

Contacting Us

Our Oxford gallery currently opens during exhibitions, according to the hours on our VISIT page (normally Thursday 10am-3pm / Friday 10am-3pm/ selected Saturdays 12pm-5pm). The gallery operates from Wednesday to Saturday inclusive, and emails will be responded to on those days.

Description of Products

Every effort is made to ensure the descriptions, prices and specification of products on the Website are as accurate as possible. However, due to the nature of the products offered on the Website, some of these descriptions are only approximate and we reserve the right to make changes which do not materially affect the quality or performance of those products.

Your order may not be accepted if there are material errors in the description of the goods you have ordered or their prices. We will contact you immediately should this situation occur.

We may correct any error appearing in the Website or withdraw any product from sale without incurring liability. Price and availability is also subject to change without notice.

We make every effort to ensure that the colours of the artworks on this website are accurate. However, due to the nature of both computer operating system colour palettes and computer monitor displays, there may be discrepancies beyond our control.

Ordering and Purchasing

The order process is set out clearly and simply on our website and you are given the opportunity to edit or amend details that you have entered incorrectly, including product selection, quantities, delivery information, payment information and contact information. 

A contract of sale is only formed when you have completed the process of purchasing products on our website and received a confirmation email from us. You must ensure this order confirmation is accurate and inform us immediately if there is any error in it. We cannot be held responsible for any inaccuracies or errors in your order. After placing an order and sending us your payment details, you will receive an email acknowledging your order. However, please note that all products are subject to availability. We reserve the right in our absolute discretion to accept or reject any order.

The gallery operates from 9am to 5pm on Wednesday to Saturday inclusive, and orders placed outside of gallery operating hours will usually be acknowledged on the next working day.

Price and Payment

All prices on our website are in British Pounds (£).  The price of the product will be the price quoted on the Website at the time we accept your order.  All prices are subject to change without notice.

Payments are made at the point of sale via a secure server. By making a purchase, you specifically authorise us to submit information to the relevant third party for credit/debit card authorisation. If your card issuer declines authorisation for any reason, we cannot be held responsible for any delay in despatch or non-delivery of your order.

We accept the following cards: Visa credit and debit, MasterCard credit and debit, American Express. If you wish to pay by bank transfer, please contact us directly via email.

Please note that the prices shown for the artwork on the website do not include postage and packaging. This is calculated once the customer has filled in their shipping information at checkout, or in the case of some larger or heavier items, this will be calculated after purchase, based on your specific location, and charged to you separately.

Dispatch and Delivery

We aim to dispatch orders as soon as possible (usually within one week of receipt of your order, though often sooner), and we aim for artwork to reach you within 10 working days of purchase.

For UK addresses, smaller items are typically shipped by Royal Mail Second Class (which will take 2 to 3 days after shipping) or by Royal Mail Special Delivery (next day delivery). Larger items are typically sent by ParcelForce using their 48 hours service.

If you are purchasing a gift and/or need delivery by a specific date, please email me at vanessa@irvinggallery.com and I will advise on how quickly we can process your order.  

We take ever care to ensure that your purchase reaches you safely. However, you should inspect your artwork immediately upon receipt and if there is any damage to your order when it arrives, please notify us in writing via email within 24 hours and we will talk through options with you. Unfortunately, we will not be liable for any loss or damage or be able to help if you leave notifying us for a longer period of time. 

Returns, Refunds and Cancellations

If for any reason, you are not happy with your order, you have a right to return any items ordered that do not meet your expectations and to request a full refund. In this case please notify us via email within 7 days of receiving the artwork, with the full artwork details and reason for the return. The item must be safely returned to us at Irving Gallery, 28 Essex Street, Oxford OX4 3AW, undamaged, within 14 days of the original receipt.

In order to receive a full refund, you have a legal obligation to take reasonable care of the Artwork whilst it is in your possession. In preparing to return an Artwork to us you should use the original packaging and we would suggest that you use some form of delivery service that requires a signature.

Once we have received the Artwork back at the gallery (in the condition in which it was sent) we will process your refund as soon as possible. The refund will include the price of the Artwork and any original delivery costs.

The cost of returning the Artwork to the gallery is at your expense and all goods remain your responsibility until we have received them.

International Shipping

Our website will estimate international shipping costs for smaller and medium sized artworks. If you wish to place an order for an item where we state that shipping will be calculated and charged after purchase and you live outside the UK, please contact the gallery at vanessa@irvinggallery.com so we can obtain a specific quote for delivery.

Please note that for orders sent outside of the UK, you are responsible for payment of any local import taxes and duties.

The gallery cannot be held liable for any delays caused in delivery by local customs. If you are unsure as to whether what you are purchasing will have any duties to be paid, contact your local customs office.

Privacy Policy

Your personal data will be used only to process your orders, we use a secure payment system (Stripe) and do not hold any of your payment details at the gallery.

Customer details are never shared or passed to third parties and are used only in accordance with the Data Protection Act.

General

Your use of this website and any dispute arising out of such use of the website is subject to the laws of England and Wales.

If any of these terms and conditions should be determined illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.

Force Majeure

In case of force majeure, our obligations are rendered null and void. The contract between you and us can in such cases be partially or fully terminated by yourself or us.

A force majeure is defined as event of war, civil war, revolution, riot, governmental measures, strike lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. We will under such circumstances do all we can to solve the matter for our customers as soon and entirely as possible.

Variation

We may revise these terms and conditions at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms and conditions may also be superseded by provisions or notices published elsewhere on our website.

Warranty

You warrant to us that you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms and conditions. You warrant to us that you are at least 18 years of age. You warrant to us that the information provided in your order is accurate and complete. You warrant to us that the credit/debit card used to pay for the order is yours. You warrant to us that you will be able to accept delivery of the products.
